INTRODUCTION

To subscribers: You may cancel your subscription, without penalty or obligation, at any time prior to midnight of the third business day following the date you subscribed. If you subscribed using an External Service (e.g., Apple ID, Google Play), you must cancel through your External Service, as set forth in more detail below. If you subscribed through your Apple ID, refunds are handled by Apple/Google, not by Thedal. You can request a refund from Apple through your Apple ID account on your phone or at https://getsupport.apple.com. All other users may request a refund by contacting thedalsupport@gmail.com.

Welcome to Thedal! We're excited you're here and look forward to helping you find your next travel companion. We provide a service that allows users to match, communicate, and book travel companions worldwide. The following 'Terms of Service' are a binding contractual commitment ("Agreement"). We recommend reading it in full before using our service, but the most important point is this: your safety is our top priority.

For your safety, we reserve to right to remove any user for a number of reasons, but most importantly if we believe they are acting inappropriately or misrepresenting themselves. If someone has made you uncomfortable for any reason, please report them to our customer support team, either via the app or by emailing thedalsupport@gmail.com.

TERMS OF SERVICE

This Terms of Service agreement (the "Terms") governs your use of the Thedal Limited Liability Company service available through our website located at www.thedalcompanion.app.

Please read these Terms carefully. By creating a travel companion account in Thedal, you represent (1) that you have attained the legal age that is statutorily required under the laws of the state, and/or country in which you reside to form a binding contract with Thedal, (2) you have the authority to enter into the Terms of Use personally or on behalf of the company you represent; and (3) that you agree to be bound by these Terms of Service, Privacy Policy, and Cookie Policy. If you do not agree, you may not access or use the website, app, or services.

We reserve the right to modify, amend, or change the Terms at any time. Notice of any material change will be posted on this page with an updated effective date. In certain circumstances, we may notify you of a change to the Terms via email or other means, as appropriate under the circumstances; however, you are responsible for regularly checking this page for notice of any changes. We agree that future changes will not be retroactive without your consent. Your continued use of our Services constitutes your acceptance of any change, and you will be legally bound by the updated Terms. If you do not accept a change to the terms, you should stop using our Services immediately.

NOTICE CONCERNING CHILDREN: We require users of the Service to be at least 18 years of age. We do not intend for anyone under the age of 18 to use any of the features or services we offer from the Service. If you suspect that a user is under the age of 18, please notify us.

While we do our best to monitor Thedal, remember to always use your own best judgment when interacting with people on or off the app. It is not feasible for us to do accurate background checks and you agree that we will not do such checks. Some users may misrepresent themselves, so you must be careful in your use of the app. Our app is only as good as our community of users, and we rely in part on you to report inappropriate users to keep Thedal a safe and welcoming place for all.

Please note these Terms include a class action waiver and a waiver of arbitration and mediation unless ordered by the Superior Court.

ACCOUNT

Registration

In order to access certain features of the Service, you may be required register for an account ("Account"). If you access the Services through a social networking site, such as Facebook, as part of the functionality of the Services, you may link your Account with Social Networking Site account ("SNS Account"), by allowing Thedal to access your SNS Account, as is permitted under the applicable terms and conditions that govern your use of each SNS Account.

Registration Data

Before you create an account on Thedal, make sure you are eligible to use our Services. This Section also details what you can and can't do when using the Services, as well as the rights you grant Thedal.

By using our Services, you represent and warrant that:

• You are at least 18 years old;
• You are legally qualified to enter a binding contract with Thedal;
• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country;
• You are not on any list of individuals prohibited from conducting business with the United States;
• You are not prohibited by law from using our services;
• You have not have been convicted of or pled no contest to a felony or indictable offense (or crime of similar severity), a sex crime, or any crime involving violence;
• You are not required to register as a sex offender with any state, federal or local sex offender registry;
• You do not have more than one account on our Services; and
• You have not previously been removed from our Services by us, unless you have our express written permission to create a new account.
